Conditions
These general conditions (GC) govern the relations between the company PAMATREX SA and its customers. They are an integral part of the contract between the customer and PAMATREX SA and cover any product or service. These conditions have priority in any case over any other conditions sent by the buyer or appearing on its documents. The descriptions of services and features of the services and products are also part of said contract.
Delivery
The products listed in our catalogs are generally delivered without delay from our warehouses in Grandcour, Payerne or Corcelles-Près-Payerne. If shipping is not possible within 48 hours or if the goods are temporarily out of stock, the expected delivery date will be indicated by separate email. If an order cannot be delivered in one go, shipping costs will not be charged for subsequent deliveries relating to this order. In any case, we cannot be held responsible for delivery delays caused by the manufacturer.
Technical data
We are not the manufacturer of most of the products offered. All technical information, data and dimensions are based on the information provided by the respective manufacturers and do not constitute a guarantee on our part regarding specific properties. We assume no liability for possible printing and transmission errors. The illustrations are not binding.
Prices
Our prices are net prices in Swiss francs, including VAT.
Subject to errors and price or technical changes. Any legal recourse is excluded.
Shipping and packaging costs are invoiced separately.
Order
A binding order is placed when the customer presses the "Confirm order" button on the confirmation page. By placing an order, the customer makes an offer to purchase the products he has selected. PAMATREX SA reserves the right to accept or reject this offer at its discretion. PAMATREX SA confirms the acceptance of the order and its progress to the customer, at the email address that the customer provided when registering on the site. This confirmation is effective when the customer receives an email from PAMATREX SA. This email thus forms a sales contract between the customer and PAMATREX SA.
In the event of an error in the wording of the recipient's contact details, PAMATREX SA cannot be held responsible for the impossibility of delivering the product(s) ordered.
By placing an order, the customer certifies that they are 18 years of age or older.
Payment
All prices are calculated net. In the event of payment against invoice, these must therefore be paid without any deduction and no later than 10 days after the invoice date. In the event of non-compliance with this payment deadline, PAMATREX SA is entitled to charge a late payment interest of 5% as well as administration costs.
PAMATREX SA remains the owner of all goods delivered until full payment of the invoice relating thereto.
Complaints and returns
The goods are shipped at the expense and risk of the recipient. Any damage must be reported immediately to the carrier (post, railway, road carrier) in order to be able to draw up a report.
Complaints concerning the goods ordered must be notified immediately upon delivery, failing which the delivery is deemed to have been accepted.
PAMATREX SA grants a withdrawal period of 3 working days from the date of delivery of the products and undertakes to take them back, provided that they are neither damaged nor opened, and are still in their original packaging.
Warranty
All electrical products are guaranteed for one year, unless otherwise specified, from the date of issue of the invoice. The invoice serves as a "warranty certificate".
In the event of warranty execution, the defective equipment must be sent to us with a copy of the invoice. The warranty is excluded if the operating defect results from an intervention carried out by the buyer, if it comes from normal wear and tear, negligence or lack of maintenance on the part of the buyer, or if the malfunction results from force majeure.
PAMATREX SA is not responsible for guaranteeing that the products are suitable for the use for which you intend them.
Liability
PAMATREX SA cannot be held liable for damages of any kind, whether material, immaterial or physical, which could result from a malfunction or improper use of the products sold. The same applies to any modifications to the products resulting from the manufacturers. The liability of PAMATREX SA will, in any event, be limited to the amount of the order and cannot be called into question for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the products.
For all other cases not governed by these conditions of sale, the Code of Obligations applies.
Data protection
PAMATREX SA undertakes to treat its customers' data with care and to comply with the legal provisions on data protection. PAMATREX SA processes personal data for the purpose of providing and executing, in accordance with the contract and the law, the services offered. The data is not used and will NEVER be transmitted to third parties. We have a label!
Jurisdiction
Our business activities are based exclusively on Swiss law. The place of execution and jurisdiction is Payerne.
